Waiver

ASSUMPTION OF RISK, RELEASE, AND INDEMNIFICATION  

I understand that classical Pilates is a form of physical activity with the purpose of increasing my body awareness, core strength, balance, breath control, overall strength, flexibility, and postural alignment.  I understand that, as with any exercise program, there are risks associated with participating in the classes, sessions, and workshops offered by Dolphin Song LLC dba Urban Pilates (“Urban Pilates”).  I freely and voluntarily assume all risks associated with participating in such classes, sessions, or workshops or in performing any exercises outside the Urban Pilates studio pursuant to the recommendations or guidance of Urban Pilates instructors (collectively the “Activities”), including, without limitation, risk of harm, injury, or loss that may occur to me as a result of my participation in the Activities.

I understand that whether I am working in a private session, semi-private session, group mat class, or group equipment class, my instructor has my best interest in mind, and I WILL COMMUNICATE IF AN EXERCISE IS UNCOMFORTABLE OR I DO NOT FEEL WELL AT ANY TIME.  I AGREE TO LISTEN TO MY INSTRUCTOR AND HEED ALL WARNINGS, CAUTIONS, AND INSTRUCTIONS DURING ALL SESSIONS/CLASSES TO ENSURE MY SAFETY.  I understand that exercise on Pilates equipment and the mat work has risks, and I accept these risks. 

I certify that I have adequate insurance to cover any injury or damage I may cause or suffer while participating in the Activities, or else I agree to bear the costs of such injury or damage myself.  I acknowledge that I have the opportunity to consult with a health professional of my choice at any time before or during my participation, and have done so or understand the potential risks and have voluntarily chosen not to do so.  I further certify that I have no medical or physical conditions which could interfere with my safety in participating, or else I am willing to assume, and bear the costs of, all risks that may be created, directly or indirectly, by any such condition.  I hereby certify that I know of no medical condition (other than those noted above) that would increase my risk of illness and injury as a result of participation in any regular exercise program.

I hereby release Urban Pilates, its landlord, and their respective employees, agents, officers, managers, members, and contractors (collectively “Released Parties”) FROM ALL LIABILITIES, CAUSES OF ACTION, CLAIMS, AND DEMANDS that arise in any way from any injury, death, loss, or harm that occurs to me or to any other person or property that is in any way related to my participation in the Activities.  I ALSO AGREE NOT TO SUE or make a claim against the Released Parties for death, injury, loss, or harm that occurs during or results from the Activities or is any way related to the Activities.  

I PROMISE TO INDEMNIFY, HOLD HARMLESS, AND DEFEND the Released Parties against any and all claims to which the foregoing paragraph applies.  I ALSO PROMISE TO INDEMNIFY, HOLD HARMLESS, AND DEFEND the Released Parties against any and all claims for my own negligence, and any other claim arising from my conduct during the Activities.  In accordance with these promises, I will reimburse the Released Parties for any damages, reasonable settlements, and defense costs, including attorneys’ fees, that they incur because of any such claims made against them.  I agree that in the event of my death or disability, the terms of this agreement, including the indemnification obligation in this paragraph, will be binding on my estate, and my personal representative, executor, administrator, or guardian will be obligated to respect and enforce them.

In addition, by signing below, I, the undersigned, understand and agree that Urban Pilates is in no way responsible for the safekeeping of my personal belongings while I attend class. 

CANCELLATION POLICY 

Urban Pilates requires twenty-four (24) hour notice to cancel an appointment. By initialing below, I agree that I will provide notice at least twenty-four hours prior to my appointment in order to avoid being billed the full amount for the appointment.

PAYMENT

All services are payable at the time of booking and are non-refundable.
